Definition and Sentencing

The Criminal Justice and Courts Act (2015) first criminalised this behaviour, requiring proof of intent to cause distress. The Online Safety Act (2023) strengthened the law by removing the need to prove intent - under Section 66B of the Sexual Offences Act (2003), it is not illegal to share intimate images without consent, regardless of motive.
Both men and women can be prosecuted. Offenders face up to 2 years in prison, with harsher penalties if the offence is part of stalking, harassment, or broader abuse.
